These Terms of Service ("Terms") govern your use of the BarScout mobile application ("App") operated by Lucky Charm Studio LLC ("we," "us," or "our"). By downloading or using BarScout, you agree to these Terms. If you do not agree, do not use the App.
You must be at least 21 years old to use BarScout. By using the App, you represent that you meet this requirement. BarScout is a venue discovery and crowd-reporting tool; it does not facilitate the purchase or sale of alcohol.
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access. You may not share your account with others or create accounts for the purpose of manipulating crowd reports or leaderboard rankings.
BarScout depends on honest, good-faith reports from its community. By submitting a crowd report, you represent that:

Scout Points, badges, and leaderboard rankings are virtual features with no monetary value. We reserve the right to adjust, reset, or remove points and badges at any time, including in cases of abuse. Points cannot be transferred, sold, or redeemed for cash or prizes.
BarScout may offer optional rewarded advertisements that grant bonus points when watched. Watching ads is never required to use the App, and the points awarded remain virtual features with no monetary value.
"User Content" means anything you submit to BarScout, including crowd reports, display names, venue posts, and any photos or video you upload.
You retain ownership of your User Content. By submitting it, you grant Lucky Charm Studio LLC a non-exclusive, royalty-free, worldwide license to host, store, reproduce, display, and aggregate that content for the purpose of operating and improving the App.
You represent that you own your User Content or have all rights necessary to share it, and that it does not infringe anyone else's rights or violate any law.
Owners, managers, and staff of a venue may claim that venue in the App to post events, specials, photos, and video on its behalf. By submitting a claim, you represent that you are authorized by the venue to act on its behalf in the role you select.
Claims are reviewed by us before they take effect. We may approve, reject, or request more information at our discretion, and we may suspend or revoke venue access at any time — including where a claim appears inaccurate, where the venue asks us to, or where posted content breaches these Terms.
Venue accounts can see aggregate statistics about their own venue. They never receive information identifying which individual users viewed, saved, or reported at that venue.
If the only owner of a venue deletes their BarScout account, that venue becomes unclaimed and may be claimed again by an authorized representative.
Venue accounts may post a limited number of photos and short videos to their venue page. This content is temporary: it expires at the end of the venue's session, after which the files and their records are deleted.
All posted photos and video are automatically screened for unsafe content before they can appear publicly, and anything the screening flags is reviewed by our team. We may refuse, remove, or take down any photo or video at any time, with or without notice. No screening system is perfect, and automated screening is not a guarantee that content is appropriate.
By posting photos or video, you represent that you have the right to share them, that you have any permissions needed from people who appear in them, and that they accurately represent the venue.
If you see a photo or video that breaches these Terms or our Community Guidelines, you can report it from within the App. We review reports and may remove content, revoke venue access, or suspend accounts as a result.
Submitting reports in bad faith — to harass a venue or a user, or to suppress legitimate content — is itself a breach of these Terms.
Venue information in BarScout (names, addresses, hours) is sourced from third-party data providers including Google Places. We do not own, operate, or endorse any venue listed in the App. Crowd-level information is user-generated and may not accurately reflect actual conditions. Always use your own judgment when visiting a venue.
BarScout is provided "as is" without warranties of any kind, express or implied. We do not guarantee the accuracy of crowd reports, venue hours, venue posts, or any other user-generated content. We are not responsible for your experiences at any venue.
To the fullest extent permitted by law, Lucky Charm Studio LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of BarScout, even if we have been advised of the possibility of such damages. Our total liability to you for any claim shall not exceed $100.
We may suspend or terminate your account at any time if you violate these Terms or our Community Guidelines. You may delete your account at any time from Settings → Account → Delete Account in the App. Deletion is immediate and permanent; see our Privacy Policy for exactly what is removed and what is retained as anonymous venue history.
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-law provisions. Any disputes shall be resolved in the courts of Virginia Beach, Virginia.
We may update these Terms from time to time. Continued use of the App after changes take effect constitutes your acceptance of the revised Terms. Material changes will be communicated through the App.
